Terms and Conditions

Jurisdiction and Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes will be resolved exclusively in the courts of New South Wales.

Payment Terms

All prices are listed in Australian Dollars (AUD). We accept payment via credit/debit card, PayPal, Shop Pay, Google Pay, and direct bank deposit.

Orders will be processed and dispatched once payment has been received and cleared in full. Kayjay’s Magic reserves the right to withhold shipment until funds are confirmed.

Shipping and Delivery

We ship orders within 2–5 business days. Delivery times vary depending on location and carrier. Kayjay’s Magic is not responsible for delays caused by postal services or external disruptions. Risk of loss passes to the customer once the order is dispatched.

Intellectual Property

All content, including text, images, product names, and formulations, are the property of Kayjay’s Magic. They may not be reproduced, distributed, or used without prior written consent.

Limitation of Liability

To the fullest extent permitted by law, Kayjay’s Magic is not liable for indirect, incidental, or consequential damages arising from the use of our products or website. Liability is limited to the remedies required under Australian Consumer Law.

Force Majeure

Kayjay’s Magic is not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, postal strikes, or other unforeseen circumstances.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

Updates to Terms

Kayjay’s Magic may update these Terms and Policies at any time. Changes will be effective once published on our website.

Return and Refund Policy

Your rights under Australian Consumer Law (ACL)

We respect and uphold your rights under the ACL. If a product is faulty, damaged, unsafe, or not as described, you are entitled to a remedy—this may include a refund, replacement, or repair depending on the nature of the issue. These rights apply regardless of any store policy and cannot be waived or restricted.

Faulty or damaged items

We take care to ensure all products are made to high standards and packaged securely. Because our products are anhydrous, they will not develop mould or germs. Faults are most likely to occur through damage in transit, incorrect items being sent, or labeling errors.

If your item arrives damaged, incorrect, or faulty, please contact us within 14 days of receiving your order. We will arrange a replacement or refund in line with Australian Consumer Law.

Change-of-mind returns

We do not offer refunds or exchanges for change-of-mind purchases. Please choose carefully before placing your order.

Return process

To initiate a return for a faulty or damaged item, please email us at info@kayjaysmagic.com with your order number and details. We’ll guide you through the next steps.

Proof of purchase

Please retain your receipt or order confirmation. If you’ve lost it, we may accept a bank statement or other proof of purchase.

Refunds

Once your return is received and inspected, we’ll notify you of the outcome. Approved refunds will be processed to your original payment method within 5–10 business days.

Shipping costs are non-refundable unless the item is faulty or incorrect.
